Cybercrime Case Filed Against Durga Prasai Over Alleged Election-Related Remarks

Kathmandu. A cybercrime case has been filed against medical entrepreneur and coordinator of the ‘National Campaign to Save Nation, Nationality, Religion, Culture, and Citizens,’ Durga Prasad Prasai, over provocative and misleading statements related to the House of Representatives election scheduled for March 5, 2026.
The government Attorney’s Office in Kathmandu filed the charge sheet at the Kathmandu District Court on Tuesday, accusing Prasai of spreading content on social media, including Facebook, that could influence and disrupt the electoral process.
According to the charge sheet, Prasai had made statements such as “The election will not be allowed,” “If the election is held, the country will break apart,” and “I am ready to die but will not allow the election,” among others.
In connection with the case, the Election Commission had earlier written to the Cyber Bureau on February 6, 2026, stating that his remarks violated Clause 4(h) of the Election Code of Conduct, 2082, and attempted to influence the electoral process.
In his videos, Prasai reportedly made a series of controversial statements, including claims that the election was “a drama organized at the instructions of foreigners,” and that elections would not be held until a Hindu kingdom and monarchy were reinstated. He is also alleged to have warned that if elections were held, historic institutions such as Singha Durbar, the Supreme Court, and the residences of industrialists could be set on fire.
Prasai, in his statement to police and government attorneys, admitted to making the remarks. He said he has been active in the medical field and political campaigns for the past 34 years. He explained that his statements were made in protest against the country’s current situation and alleged foreign interference. He further stated that under the constitutional right to freedom of expression, he had advocated establishing a Hindu nation and monarchy.
The case has been filed under Section 47(1) of the Electronic Transactions Act, 2006, which carries a punishment of up to 5 years’ imprisonment, a fine of up to Rs 100,000, or both if convicted.
Prasai was arrested on 6 February 2026 from Sunil Bista’s residence in Dakshinkali-1, Chalnakhel, Kathmandu, and later released on bail. Authorities have also sought further action under Section 57 of the National Criminal Procedure (Code), 2017, citing that he has not been in contact following his release.
