Kathmandu: The government has made a legal provision allowing the subdivision of land falling under power transmission line rights of way. The provision has been introduced through the third amendment to the Land Use Regulations, 2079 BS, to address long-standing land-related disputes arising during the construction of transmission lines.
The provision came into effect after it was published in the Gazette on 27 Kartik. Previously, landowners were unable to subdivide land located within the transmission line right of way. This had created financial and social difficulties, including obstacles to land transactions, inheritance distribution, and access to bank loans using land as collateral.
Under the new provision, land can be subdivided if the concerned project submits a recommendation along with proof of land acquisition decisions and compensation. The subdivision will be done in a way that ownership of the land remains in the name of the original landowner. The regulation states that land ownership can be maintained while allowing subdivision within the right of way.
Despite the provision allowing subdivision, safety standards will remain unchanged. No houses or physical structures can be built within the specified distance from the center of the transmission line. Planting tall trees and conducting activities considered risky within the area are also prohibited.
The width of the right of way has been defined based on the voltage capacity of the transmission line. For 66 kV and 132 kV lines, the width is set at nine meters on each side of the center line, totaling 18 meters. For 220 kV lines, the width is 15 meters on each side, totaling 30 meters. For 400 kV lines, the width is 23 meters on each side, totaling 46 meters.
During transmission line construction, land required for tower placement is fully acquired through compensation. However, land beneath the transmission wires remains under the landowner’s name, with compensation ranging from 10 to 25 percent paid for usage restrictions. With the new provision allowing subdivision of land within the right of way, land transactions are expected to become easier, enabling landowners to legally utilize their property.
