Teenager Files Rape And Cybercrime Case Against Alleged Boyfriend

Kathmandu: A 17-year-old girl has filed a rape and cybercrime case against a 20-year-old man she met while studying in college. The District Attorney’s Office has filed a charge sheet at the Kathmandu District Court.

According to police, the accused is Dipesh Kumar Giri, originally from Sarlahi and currently residing in Shankharapur, Kathmandu. Both were studying at Shankharapur Polytechnic College. Giri was in his third year of a diploma course. The girl was in her first year.

The charge sheet states that in Asoj 2081 BS, the accused took the teenager to his room and raped her against her will. Police say he also took objectionable photos and videos of her on his mobile phone.

Police say the accused later threatened to post the photos and videos on social media. Due to fear, the girl left the college and enrolled in Grade 11 at another school in Gokarneshwor about six months ago. Police say the accused continued contacting and threatening her even after that.

According to the police file, on 17 Mangsir 2082, the accused called the girl to his room, saying he would delete the photos and videos. Police say he instead tried to force her again. When she resisted, he allegedly burned her right hand with a lit cigarette and subjected her to physical and mental abuse.

Police also state that the accused posted the victim’s nude photos on Facebook and TikTok.

In his statement, Giri claimed they were in a romantic relationship and that the sexual relationship was consensual. He admitted threatening the girl and posting her nude photos on social media.

The prosecution has sought punishment under Section 219 of the Criminal Code, 2074 and Section 47 of the Electronic Transactions Act, 2063. As the victim was between 16 and 18 years old at the time, a corresponding prison sentence and fine have been demanded.

If the charges are proven by the court, Giri can be sentenced to ten to 12 years in prison, a fine of five hundred thousand rupees as per the Criminal Code, as well as an additional fine of up to one hundred thousand rupees or imprisonment for five years, or both, as per the Electronic Transactions Act, 2063.
